Overview

These Terms & Conditions (“Terms”) govern your use of the Holistically Rx website, telemedicine platform, and all related services provided by Holistically Rx, LLC. (“we,” “us,” or “HRx”). By using our services, you agree to these Terms. If you do not agree, please do not use our platform.

Important notice: prescriptions are issued only when clinically appropriate, at the sole discretion of an independent licensed provider. Compounded medications are not FDA-approved; they are prepared by licensed US-based pharmacies. Our services are not a substitute for emergency care — call 911 in an emergency.

1. Who can use our services

You must be 18 years of age or older to use any Holistically Rx services. By creating an account or booking an evaluation, you confirm that you are at least 18. We do not knowingly collect information from or provide services to anyone under 18. If we determine that a user is under 18, we will immediately terminate their account and delete any associated data.

2. What we provide

Holistically Rx is a physician-led telemedicine platform that connects patients with board-certified, state-licensed providers for integrative-medicine care — including weight management, hormone optimization, longevity protocols, and advanced diagnostics. Here is exactly what our services include and do not include:

• Connect you with a licensed provider for a telemedicine evaluation.
• Coordinate physician-managed treatment programs, including dose management and follow-up.
• Coordinate prescription fulfillment through licensed US-based pharmacies and lab testing through partner laboratories.
• Provide reminders and follow-up support during your care.
• Process your payment securely for the services you select.

What we do not do:

• Guarantee that you will receive a prescription or treatment recommendation — that decision is made solely by the provider.
• Manufacture, sell, or dispense medication ourselves — medications are dispensed by licensed pharmacies.
• Act as your attorney or provide legal advice.
• Replace your primary care physician or serve as your emergency healthcare provider.
• Bill or interact with your health insurance in any way.

3. The evaluation and provider independence

When you book an evaluation with Holistically Rx, you will be connected with an independent, licensed provider. The provider conducts your evaluation and makes their own professional determination about whether to prescribe or recommend treatment. We do not instruct, influence, or pressure any provider to approve or deny a treatment.

The provider’s decision is final. If the provider determines that a treatment is not appropriate for you, you will not receive it. This is a medical judgment, and we respect the independence of every provider in our network.

4. Payment, subscriptions, and refunds

Our services are cash-pay. We do not bill health insurance for evaluations or treatment programs; HSA/FSA funds may be used for eligible care. Current pricing, dosing, and package options are shown in our booking platform at the time you book.

You are never charged for treatment until a licensed provider reviews and approves it. A temporary authorization hold may be placed to confirm your payment method and is released if you are not approved.

Automatic renewal — many of our programs are subscriptions that renew automatically. Unless you cancel, your subscription continues for successive terms (for monthly programs, each month), and your payment method is charged at the then-current price at the start of each term until you cancel. The billing frequency and any minimum package term are disclosed at checkout before you purchase.

Easy cancellation — you may cancel at any time, and cancelling is as simple as signing up: manage your subscription from your patient portal or email Info@holisticallyrx.com, and we will process your cancellation promptly. Cancellation stops future renewals; it does not by itself refund a term already begun, except as described below or as required by law.

Most programs are month-to-month; some multi-month packages have their own terms, shown at booking. To request a refund or resolve a billing issue, email Info@holisticallyrx.com with your account details and the reason for your request. Refunds are processed within 10 business days of approval.

5. Your account

To use our services, you will create an account on our platform. You are responsible for keeping your account information accurate and your login credentials secure. You must not share your account with anyone else.

You agree to provide truthful and accurate information during registration and throughout your evaluation. Providing false information to a provider during a medical evaluation is a serious matter and may have legal consequences. We reserve the right to terminate your account if we believe any information you provided is false or misleading.

6. Your responsibilities

When you use Holistically Rx, you agree to the following:

• Be truthful with your provider about your medical history, current medications, and conditions.
• Be at least 18 years old.
• Be a resident of the state in which you are receiving care.
• Comply with all applicable federal, state, and local laws.
• Use treatments only as prescribed, and only for yourself.
• Not attempt to access another user’s account or information.
• Not use our platform in any way that could harm other users or the integrity of our services.

7. Intellectual property

All content on the Holistically Rx website — including text, images, logos, graphics, and other materials — is owned by Holistically Rx, LLC. or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or use any of our content without our written permission.

8. Links to third-party websites

Our website may link to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or terms of any third-party site. If you visit a linked site, you do so at your own risk.

9. Limitation of liability

To the fullest extent permitted by law, Holistically Rx, LLC. is not liable for any indirect, incidental, special, or consequential damages arising from your use of our services. This includes, but is not limited to, damages for loss of profits, data, or goodwill.

Our total liability to you for any claim arising from these Terms or your use of our services is limited to the amount you actually paid to Holistically Rx for the specific service at issue.

10. Disclaimer of warranties

Our services are provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not guarantee any specific outcome from a provider evaluation or treatment program. The provider’s clinical decisions are beyond our control.

11. Indemnification

You agree to defend, indemnify, and hold harmless Holistically Rx, LLC., its officers, directors, employees, and agents from any claims, damages, or expenses (including attorney’s fees) arising from your use of our services, your violation of these Terms, or your violation of any third party’s rights.

12. Changes to these terms

We reserve the right to update these Terms at any time. If we make changes, we will post the updated Terms on our website with a new effective date. By continuing to use our services after changes are posted, you agree to the updated Terms.

13. Dispute resolution — binding arbitration and class-action waiver

Please read this section carefully — it affects your legal rights. Most concerns can be resolved quickly. Before starting any formal proceeding, you agree to first contact us at Info@holisticallyrx.com and attempt to resolve the dispute informally, and we will do the same.

Binding arbitration — if we cannot resolve a dispute informally, you and Holistically Rx agree that any dispute arising out of or relating to these Terms or our services will be resolved by final and binding arbitration administered by a recognized arbitration provider under its applicable rules, rather than in court — except that either party may bring an individual claim in small-claims court or seek relief for intellectual-property infringement.

Class-action waiver — you and Holistically Rx agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate or join more than one person's claims.

Your right to opt out — you may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing Info@holisticallyrx.com with your name and a statement that you wish to opt out. Opting out will not affect any other part of these Terms.

This section does not waive any right that cannot be waived under applicable law, and nothing in it limits your ability to file a complaint with a government agency.

14. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Oklahoma City, Oklahoma.
